Premise

The National Institute of Optics of the National Research Council (CNR-INO) adopts the principles of Open Science and promotes the implementation of the principle of Open Access (Open Access) in accordance with the Berlin Declaration on Open Access to Knowledge in the Sciences and Humanities signed by the CNR on March 21, 2013.

This policy applies the Recommendation of the European Commission of 17 July 2012 on access to scientific information and its conservation (2012/417/EU) in OJ EC L 194/39 of 21 July 2012 in which the EU Commission asks the academic institutions of the Member States to define and implement policies for the dissemination of scientific publications and open access.

This policy considers the Decree Law of 8 August 2013, definitively approved by the Chamber of Deputies on 3 October 2013 and converted with amendments by Law 7 October 2013, n. 112.

This policy is drawn up in compliance with the Position Statement on Open Access to scientific research results in Italy, signed by the representatives of the CRUI and of the Public Research Bodies, including the CNR, participating at the MedOANet National Workshop on 29 January 2013.

Principles and purposes

The CNR-INO adopts the principles of full and Open Access to scientific production and undertakes to promote the free online dissemination of the Institute's research products, to ensure the widest dissemination and to make the publicly funded products available.

The CNR-INO proposes to create Open Access to research products (e.g. publications, data, software) through the institutional repository of CNR, therefore through self-archiving (known as Green Open Access) as well as through any other useful tool, in compliance with the laws concerning the protection of intellectual property, confidentiality and protection of personal data, as well as the protection, access and enhancement of cultural heritage.

Complementing the Institutional Repository, thanks to the collaboration with the CNR-ISTI, the CNR-INO pursues the goals of Open Access through the development and maintenance of a portal (CNR-INO Open Portal) dedicated to the fruition of the research products deposited in the Institutional Repository.

Deposit Policies

The Institutional Repository is aimed at welcoming and making visible every product of the Institute's research. The CNR-INO favors Open Access, subject to the limitations coming from laws and contracts.

The CNR-INO establishes that, starting from the date of entry into force of this policy, each unit of personnel belonging to the CNR-INO, as author of a research product, deposits: (i) the information on the product (metadata) and (ii) a digital version of the research output for open access purposes.

In the case of a published product, the digital copy must be deposited in the version permitted by the publisher for open access dissemination.

In the case of a software or dataset type product, it is suggested that the digital version of the product will be deposited in an appropriate repository for these types of digital objects (e.g. Zenodo). In this case, the product deposited in the Institutional Repository will contain a reference to the digital version.

You can derogate from point (ii) only in the case of: (a) refusal by the publisher, (b) documented refusal of one of the co-authors, (c) reasons of public or national security, (d) reasons of privacy or presence of sensitive data.

The copy must be stored as soon as possible, and at the latest at the time of publication.

The CNR-INO staff, as the author of a research product, is required to take note of which rights they have transferred to the publisher, before proceeding with the deposit of the product.

The CNR-INO invites its staff, when signing an editorial contract, to reserve the right to use their work for teaching or research purposes, including the possibility of depositing the work in the institutional repository, avoiding to automatically assign all rights necessary for economic exploitation, including those not essential for the publication of the contribution.

Where a copy is already deposited in an Open Access repository, it is sufficient to indicate the reference (URL) to the digital version of the object in that archive in the information required in the Institutional Repository.

Support and dispute resolution

The "CNR-INO Open Access" Working Group has been established, composed of the Director, a scientific manager, two members of the Project Office, two technical representatives for the Open Portal service, one representative with operational tasks and some researchers appointed by the Director.

The Working Group constantly monitors the application of the policy, provides technical support to the authors of scientific contributions, takes care of the storage and publication of scientific contributions and related metadata, maintains a network of contacts with the Italian and international Open Access community.

The Working Group also provides the guidelines necessary for the application of this policy.

Any disputes regarding the interpretation of the policy are entrusted to the Institute Council.

Responsibility

The person responsible for the information contained in the research products published in the Institutional Repository and for their possible use is solely the CNR-INO staff who, as author, provided for the deposit of the product.

The Working Group, while guaranteeing adequate support, is not responsible for any injuries to third parties deriving from the use of the information contained in the scientific contributions.

Final provisions

This policy comes into effect on March 1st, 2023.

The Working Group reports to the Institute Council on the application of the policy.

The policy will be reviewed at least every two years.
